Terms of Use

1. Scope of Application

These Terms of Use apply to the use of the online portal under www.eyecon.ai as well as all services offered by EyeCon GmbH via it. The offer is aimed exclusively at entrepreneurs within the meaning of § 14 BGB. Consumers are excluded from use.

2. Description of services

EyeCon provides an AI-based platform for analyzing video recordings of conveyor belt systems. The platform enables users to upload videos, have them analysed and retrieve evaluation results, warnings and recommendations for action.

In addition, EyeCon offers the purchase of individual scans, scan packages and starter kits consisting of hardware (e.g. camera, lighting, accessories).

3. Registration and User Account

The use of the portal requires registration. The user is obliged to provide truthful and complete information and to treat his access data confidentially.

4. Test scans

Users who register up to and including 30.06.2026 will receive five free test scans. There is no entitlement to continue or repeat this promotion.

5. Upload videos

Users upload videos independently. An automated upload does not take place. The videos are intended to show only conveyor belt systems. If people are recorded due to carelessness, automatic anonymization (e.g. blurring) takes place.

6. Rights of use to uploaded video material

By uploading video material, the user grants EyeCon GmbH a simple, temporally and spatially unlimited, transferable right of use to the uploaded videos.

The right of use includes in particular the right to:

The use is exclusively for the purpose of analyzing conveyor belt systems and the further development of EyeCon's AI systems.

The user assures that he has all the necessary rights to the uploaded videos and that no rights of third parties are infringed by the transfer of the rights of use. If people are recorded due to carelessness, the user agrees that automatic anonymization will take place.

Ownership of the original videos remains with the user. There is no entitlement to the deletion of the videos if they have already been anonymized and used for AI training.

7. Use of Analysis Results

The results of the AI analysis are used exclusively to support decision-making. They do not constitute binding assurances, warranties or security-related releases.

AI does not replace human judgement, no technical examination and no safety-related control on site.

8. Liability

EyeCon is only liable for intent and gross negligence. In the event of simple negligence, EyeCon shall only be liable in the event of a breach of material contractual obligations and limited to foreseeable damage.

Liability for production losses, indirect damages or consequential damages is excluded to the extent permitted by law.

9. Hardware

In the case of starter kits, EyeCon acts as a retailer. Product liability for manufacturing defects lies with the respective manufacturer. EyeCon is not liable for improper use or installation.

10. Payment Processing

Payments are made through Stripe. Accepted payment methods are credit card, PayPal, prepayment and, in exceptional cases, invoice with payment term.

11. Contract Term and Termination

Contracts for scan packages end when the scans are used up or the agreed term expires.

12. Final Provisions

German law applies. The place of jurisdiction is – as far as permissible – the registered office of EyeCon GmbH.

Cookie Policy

Technically necessary cookies as well as cookies for the functionality of the portal are used. In addition, cookies may be used for session management and security.

Reporting illegal content is possible via the portal or by e-mail.

EyeCon is not a hosting service in the sense of open user content, but operates a closed B2B system.

EU Data Act - Transparency Information

User data is used exclusively for the fulfilment of contracts and to improve AI. It will not be passed on to third parties unless required by law.

The anonymized use of the data for AI training is part of the contract.

Product Safety and Liability Information

The AI analyses do not constitute a safety-related release. The responsibility for the operation, maintenance and safety of the conveyor belt systems remains with the user.

EyeCon does not guarantee the complete detection of all fault conditions.

AI Transparency and Explanatory Document

1. Use of artificial intelligence

EyeCon GmbH uses AI-based systems on its platform to analyze video recordings of conveyor belt systems. The aim is to identify potential fault conditions at an early stage and to support maintenance and repair decisions.

2. How AI works

The AI models used were trained on the basis of anonymized video recordings and recognize patterns, deviations and abnormalities in the operating behavior of conveyor belt systems.

The results are based on statistical probabilities and automated pattern recognition.

3. Limits of AI

4. Training the AI

Uploaded videos are automatically anonymized. The anonymized data can be stored permanently and used for further development and training of the AI models.

There is no training on personal, non-anonymized data.

5. Risk classification

EyeCon's AI system does not constitute a high-risk AI system within the meaning of the planned EU AI Act because:

The offer of EyeCon GmbH is aimed exclusively at entrepreneurs within the meaning of § 14 BGB.

There is no right of revocation pursuant to §§ 312g, 355 BGB. Consumers are excluded from using the platform as well as from concluding contracts.

By registering, the user expressly confirms that he or she is acting as an entrepreneur.

Availability and Maintenance

EyeCon strives for a high availability of the platform. However, continuous and uninterrupted availability cannot be guaranteed.

EyeCon is entitled to carry out maintenance work that may result in a temporary restriction or interruption of the Services.

Export and Legal Compliance

The User undertakes to use the Platform exclusively in accordance with applicable law. Use in countries or for purposes that violate export control or sanctions regulations is prohibited.
